Pasha Funding does not originate loans, make lending decisions, extend credit, guarantee financing approval, or provide financial, legal, tax, or investment advice.

Our Platform is designed to simplify the financing process by allowing homeowners to explore available financing options and enabling contractors to offer financing opportunities to their customers through participating lending partners.

Any financing product displayed through the Platform is offered solely by the applicable lender or financing provider, which is independently responsible for underwriting, approval decisions, loan disclosures, funding, servicing, collections, and compliance with applicable lending laws.

2. Eligibility

To use the Platform, you represent and warrant that:

  • You are at least 18 years of age.
  • You have the legal authority to enter into binding agreements.
  • All information you provide is truthful, accurate, and complete.
  • You will promptly update any information that becomes inaccurate.
  • Your use of the Platform complies with all applicable federal, state, and local laws.

If you are using the Platform on behalf of a business, contractor, corporation, partnership, or other organization, you represent that you have authority to bind that entity to these Terms.

Nothing on the Platform constitutes an offer to lend money or a commitment that financing will be available.

4. No Lending Relationship

Pasha Funding is not a bank, finance company, mortgage lender, loan broker, credit union, or licensed lending institution unless expressly stated otherwise.

We do not:

  • Approve or deny financing applications.
  • Determine interest rates.
  • Set repayment terms.
  • Issue credit decisions.
  • Fund loans.

5. Contractor Participation

Contractors using the Platform are solely responsible for:

  • Complying with applicable consumer protection laws.
  • Providing truthful information regarding their business.
  • Accurately representing products and services offered.
  • Obtaining any required customer authorizations before submitting financing requests.
  • Following all lender program requirements applicable to their participation.

Participation on the Platform does not create an employment relationship, agency relationship, partnership, joint venture, or franchise between Pasha Funding and any contractor.

We reserve the right to approve, suspend, restrict, or terminate contractor access to the Platform at our sole discretion.

6. Homeowner Use

Homeowners may use the Platform to explore financing opportunities for eligible home improvement projects.

By submitting information through the Platform, you authorize Pasha Funding and participating financing providers to review the information you provide for the purpose of determining available financing options.

Submitting a financing request does not obligate you to accept financing, complete a project, or enter into any agreement with a contractor or lender.

Likewise, submitting information does not guarantee that financing options will be available.

Homeowners remain responsible for reviewing all loan disclosures, repayment obligations, interest rates, fees, privacy notices, and contractual terms provided directly by any lender before accepting financing.

7. Account Registration

Certain features of the Platform may require you to create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated as needed.

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. If you believe your account has been accessed without authorization, you should notify Pasha Funding immediately.

We reserve the right to suspend or terminate accounts containing false information, duplicate accounts, fraudulent activity, or conduct that violates these Terms.

8. Acceptable Use

You agree to use the Platform only for lawful purposes and in accordance with these Terms.

When using the Platform, you agree that you will not:

These third parties operate independently from Pasha Funding and maintain their own approval criteria, underwriting guidelines, loan products, disclosures, privacy practices, and customer agreements.

Pasha Funding does not control or guarantee:

  • Loan approval decisions
  • Interest rates
  • Monthly payments
  • Repayment terms
  • Funding timelines
  • Credit limits
  • Promotional financing offers
  • Customer service provided by lenders

Any agreement entered into between you and a financing provider is solely between those parties. You are responsible for reviewing all applicable disclosures and contractual documents before accepting any financing offer.

10. Accuracy of Information

You certify that all information submitted through the Platform is accurate, complete, and truthful to the best of your knowledge.

Providing false, incomplete, or misleading information may result in delayed processing, denial of financing opportunities, suspension of your account, or permanent removal from the Platform.

Pasha Funding reserves the right to request additional information or documentation to verify identities, business information, project details, or other information submitted through the Platform.

11. Communications and Electronic Consent

By using the Platform, you consent to receive communications electronically, including emails, text messages, notifications, and other communications related to your account, financing requests, customer support, or Platform updates.

Electronic communications satisfy any legal requirement that communications be provided in writing.

You may opt out of certain marketing communications at any time; however, transactional or account-related communications may continue as necessary to provide our services.

Message and data rates may apply if you choose to receive SMS communications through your mobile carrier.

12. Intellectual Property

18. Limitation of Liability

To the maximum extent permitted by applicable law, Pasha Funding, its owners, affiliates, employees, contractors, licensors, technology providers, and business partners shall not be liable for any indirect, incidental, consequential, exemplary, punitive, or special damages arising out of or relating to your use of the Platform.

This limitation includes, without limitation, damages related to:

If Pasha Funding is found liable for any claim arising from your use of the Platform, our total liability shall not exceed the greater of one hundred dollars ($100) or the amount you paid directly to Pasha Funding for the specific service giving rise to the claim during the twelve (12) months preceding the event.

Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, portions of this section may not apply.

19. Indemnification

You agree to defend, indemnify, and hold harmless Pasha Funding, its affiliates, officers, employees, contractors, licensors, and partners from and against any claims, liabilities, damages, judgments, losses, costs, or expenses, including reasonable attorneys’ fees, arising from or related to:

Nothing in these Terms prevents either party from seeking temporary injunctive or equitable relief where appropriate.
